Selling conditions

1. Subject
The following General Terms and Conditions of Transaction settle legal regulations between Poppers.com and a client who orders goods in an online store. Exclusively these terms and condiotions of transation are in force as well as ? those limited to a concrete area of application ? special and additional terms and conditions, inclusion of which into contractual relationship is established with buyer. Terms and condittions of buyer which are contradictory to those mentioned above are not in force.

2. Offer, agreement and price
You need to be adult to do shopping in an online store. All offers presented by us are subject to these terms and conditions of transation.
Order is binding. Contract is brought into effect at the moment of sending goods or confirmation of order by Poppers.com within two weeks from the date of ordering.
As far as price fixing is concerned, binding are these price lists which are in force on the day of ordering. All prices include VAT. Poppers.com reserves the right to change prices.

3. Payment
Buyer can choose from the following forms of payment:
Credit card (VISA, Eurocard/Mastercard, Amex, Diners Club) ? delivery time about 48 hours
Transfer ? delivery time 8 ? 10 days
Direct payment in advance ? immediately after the receipt of payment (about 48 hours).
After checking data of order, confirmation of order shall be sent by e-mail.

4. Delivery
We deliver goods by courier consignment DHL. Ordered goods are delivered in a neutral packaging with discreet information about consigner. Delivery is performed on week days on a regular basis. Indemnities due to exceeding the term of delivery are excluded.
Consignment costs are calculated as follows:
For credit card, transfer or direct payment:
Europe: Euro 8.00

5. Right to contract out of an agreement
Refusal to accept parcels
If parcels are not accepted by adressee, we have the right to demand reimbursement of all related costs. These costs, depending on form of delivery, include consignment cost to anf from, collection cost and handling charge.

6. Property law reservation
Delivered goods remain the property of Poppers.com until total amount is paid.

7. Warranty responsibility/return/complaint/exchange
Poppers.com accepts warranty responsibility for the period of one month concerning transfer of risk for all shortages subject to statutory warranty responsibility. Warranty claims are at first limited to recouping that is exchange of goods. If recouping fails, buyer can choose between discount and contracting out of purchase agreement. Insignificant, common in trade quality deffects which cannot be avoided technically as well as defects resulting from improper handling are not the grounds for indemnities. Any defects of delivered goods shall be immediately described in Whiting within 14 days from the date of delivery.
Poppers.com does not guarantee popularity of offered products or their usefulness for a certain purpose. Prosecuting us for direct or indirect damages that will occur to buyer of user as a result of economic loss, loss or damage of property, death or injury of people and whatever related to the purchase or delivery of any product is excluded unless there are proofs of guilt of Poppers.com, relying in intended activity or gross negligence. Apart from that there are in force separately stated settlements concerning the exemption of responsibility.

For hygienic reasons erotic toys, moisturizing gels, condoms, DVDs and underwear are not subject to exchange. If a DVD, CD or video cassette is damaged, client can exchange it exclusively for the same article. When sending back a product, consigner has to cover costs of a parcel (unpaid consignments are not accepted).

8. Data protection
Poppers.com is obliged to deal with client?s personal data confidentially under the act on data protection.
